NATIONAL ASSEMBLY OKAYS AUTONOMY FOR LG, INEC TO BE IN CHARGE OF LOCAL GOVERNMENT ELECTIONS in Naija

The National Assembly on Tuesday, granted full Financial and Administrative Autonomy to all the 774 Local Council Authorities across Nigeria by Amending Section 124 of the Nation’s Constitution.

The Section provides a consequential provision for the making of the Local Councils, a full third tier Government without undue interference from the State Governments.

The Ammendment was one of the 22 others approved by the House of Representatives last week and ratified by the Senate on Tuesday.

Both Chambers had through a conference committee harmonised versions of the ammendments into the constitution carried out by each of them last month.

By the development, the National Assembly had ratified all the 23 clauses and sections that had been ammended by both Chambers.

The newly ammended document which would be sent to States Houses of Assembly, for approval, also approved the creation of the Office of Auditor – General of the Local Government as well as the State Local Government Service Commission.

The Section equally deleted the State
Independent Electoral Commission from the Constitution thereby vesting the Powers to Conduct Council Elections on the Independent National Electoral Commission.

It however, retained the immunity clause in the Constitution for the President and Governors by adopting the Senate version of the ammendments on the issue and rejected the House of Representatives version which removed the immunity clause.

The National Assembly also made provisions for Independent candidacy in future Elections in Nigeria by Ammending Sections 65 and 106 of the 1999 Constitution!!!

Mr Diamond Tietie has said he is touched and moved to pains as a result of the infrastructural decay most especially in the area of roads that are non existent in Delta State after traveling from Warri to Abraka. Mr Tietie who hails from the Ugwezi Ouarter of Urhuoka, Abraka, Ethiope East Local Government Area of Delta State, made this statement during his declaration of his membership for the party in his ward,( Abraka Ward one) Which is also the ward of Chief Great Ovadje Ogboru Governorship Candidate of the 2019 Election.
While Commending Obarisi Senator Ovie Omo Agege, Deputy Senate President, for giving Urhobo Voice at the national level and at the same time made history as the first Urhobo man to attain the position. He also showered praises on Chief Great Ogboru for his doggedness and tenacity of purpose and promised to work with both leaders to take the party to greater heights.

On his part,Engr. Elvis Ayomanor Deputy State Chairman of the party thanked Mr Tietie for his courage and determination to join the party at a time when elections are over. Illegal bunkering activities in Ifie is a threat to our operations, Depot Managers tells Amgbaduba

Iffie -kporo , THE Delta State Commissioner for Oil and Gas, Chief Emman Ambgaduba, who on Thursday paid a working visit to Ifie-Kporo community in Warri South Local Government Area of the state for a working relationship in monitoring the activities of their tank farms in the area. Has urged the oil companies in the area to strenghten their tiers with host communities and the government .

The managers who spoke at different interview lamented of the dangers posed by rampant illegal bunkering activites in Ifie-Kporo community, which according to them is a serious security threat to the continued survival of the companies , urged the government to be their saving grace in finding a lasting solution to bunkery activities in the area.“Your cooperate social responsibility with the government and host community should not be swept under the carpet.” Amgbaduba declares.

According to the Commissioner, “Upon my inauguration as commissioner of the ministry, I deemed it fit to visit these facilities to know if there are challenges. The idea is for us to see how we can work together.

Amgbaduba who paid a working visit to Keonamex Petroleum, KPI, AYM Shafa, Pinnacle Oil and Gas Ltd, Matrix Energy Depot as well as A & E all in Ifie-Kporo, popularly called Ifie community with officials from the ministry of Oil and Gas among others that made the entourage spoke passionately on how companies should not be swayed away from living up to their corperate social responsibility with the government and their host community.

Amgbaduba”s reactions to some of the challenges bedvilling the oil companies shows that Okowa stronger Delta is achievable, that his visit was to collate information regarding their operations if there are challenges, complaints, for the purpose of familiarization, ensuring compliance to global best practices while running the Tank Farms, the need for collaboration and the ultimate briefing of an eminent meeting that will be scheduled by the office of the honourable commissioner Ministry of Oil and Gas Delta State with Depot Managers in the whole of Delta State.

He noted that the meeting will hold either in Asaba or Warri in order to properly streamline issues bordering the companies, he said the Delta State Government, headed by Sen. Dr. Ifeanyi Okowa, Governor of the state is poised to see that business strives well in the state without any hiccup.

Maintaining that he is carrying out the directive of his boss, His Excellency, the Governor of Delta State.

However, all the five Tank Farms visited yesterday, the Managers and all those that spoke on behalf of their companies at the different meetings in their offices identified similar challenges.

The Tank Farms Managers decried why illegal bunkering activities will be done indiscriminately in the open in a sensitive area close to Tank Farms, expressing worry on their continued operations amidst such potential impending danger.

They also identified multiple taxation from both state, local and other strange authorities, stressing that they hope to operate in a decent environment, the Managers while declaring their readiness to pay their taxes as at when due, maintains that they really want to know exactly who they will be dealing with to avoid multiple taxation on their parts.

Another challenge affecting the operations of Tank Farms in the area, identified by the Managers include the Ifie concrete road, the only access road to the Tank Farms, they had called on the Delta State Government to come to their aid by fixing the road, stressing that before now, Tank Farms in the area combine to contribute money in fixing it, maintaining that if the state Government can rescue them from such baleful experience, it will be highly appreciated.

Meanwhile, the story is not different from managers of all the Tank Farms visited yesterday, they have all conspicuously hammered on the fact that they are in constant touch with the community authorities.

Noting that the relationship so far has been harmonious, peaceful and cordial, adding that there is no cause for alarm.

Nevertheless, in all the five Tank Farms visited yesterday, only AYM SHAFA and MATRIX took out their time to explain how they are delivering on their corporate social responsibility.

In their separate meetings with the honourable commissioner, Assistant General Manager, AYM SHAFA, Soladeni A. O noted that in just a year and few months of operations in the area, they have renovated an hospital fully equipped for the community, noting that they have also provided portable drinkable water for the community.

He explained further that by way of encouraging people of the community, particularly the leadership, all materials supply is given to them to supply which according to him is in compliance with their corporate social responsibility.

He maintains that they also provided employment opportunities for the host community and impacted communities like Ubeji amongst others.

On his part, General Manager of MATRIX, Engr. Francis Eiu also alluded that they have done a lot for host community, stressing that they have built standard general hospital worthing over 400 million naira.

Engr. Francis continued that Matrix have also spent a lot in the empowerment of women in the locality, provision of scholarship to students among other vital services they have been renderimg over the years.

The MD noted that seeing the Warri Port coming back to life, functioning like that of Lagos remains their major dream, adding that if the Government can dredge the Excravos bar, it would have been good for Deltans and investors.

Nevertheless, Commisioner Amgbaduba promised to get back to them via a meeting that will be scheduled in order to address the issues raised, noting that some of the challenges will be tables before the Governor.

It would be recalled that the commisioner in each of the Tank Farms visited took a tour round the facilities to ensure if they conforms to global best practices.

The depot officials visited include Ikechukwu, (KEONAMEX PETROLEUM, KPI), Engr. Saladeni, (AYM SHAFA), Engr. Saliyu Jabiru (Pinnacle Oil and Gas Ltd), Engr. Francis Eiu, (MATRIX) as well as Engr. Okafo ( A & E) among others that were present.

The commissioner’s entourage include permanent secretary Oil and Gas ministry, Delta State, Chief Aleka, Director Local content, ministry of oil and gas, Delta State, Comr. Emmanuel Akpule, special assistant to the commisioner among others.

Ambode Vows to unveil tinubu Secrets if he brings out his leg again

There are emerging indications that the immediate past Governor of Lagos State, Akinwunmi Ambode, have come under pressure to fight back in the prevailing skirmishes to destroy his political career. A party source close to the former Lagos Governor revealed to National Daily that Ambode has warned that the continuous attack against him after being denied the ticket of the All Progressives Congress (APC) in Lagos State for a second term in the 2019 governorship election and obstructing his opportunity for ministerial appointment has gone beyond tolerance boundary. The source said that the former governor at an emergency meeting with his loyalists, warned that “enough is enough” threatening that further attacks would provoke him to open the can of worms on the running of Lagos State Government from 1999.

Our source, who appealed for anonymity, said that the former Lagos Governor observed at the meeting that the Tuesday episode in which the operatives of the Economic and Financial Crimes Commission (EFCC) had their plot to allegedly plant foreign currencies at his residence in Epe foiled by the people signaled a turning point that the battle against him is changing pattern and that he is prepared to fight back henceforth. The disappointment of the EFCC in the plot to raid Ambode’s residence on Tuesday was said to be a mark of stalemate in the power tussle in Lagos State. Ambode was said to have cautioned that his calmness and loyalty should not be taken as weakness, adding that the empire may collapse when the battle is broadly opened.

National Daily investigation revealed that Ambode had fore-knowledge of the EFCC plan to raid his two residence in Lagos; and waited for them, mobilizing the people. An EFCC source disclosed to National Dailythat there was division in the commission over the assignment to raid Ambode’s residence while investigations were still going on on the petition against the former governor.

The source said that some of the operatives were suspicious that the impromptu search would obstruct transparency of the investigations which may make the findings and conclusions misleading. It was purported that in the midst of the disagreement and insistence of some senior officials that the operation must take place, that some other officials loyal to the former Lagos State governor put him on notice about the plot to raid his residence in Lagos.

It was alleged that while the operatives were to deepen their corruption investigations, there was also the intention to cart away certain documents with inherent records that could indict or incriminate some top party leaders and government officials in Lagos State when those documents are exposed to the public. The documents were said to contain details of payments and circumstances such payments were made to each recipient. Our source that the documents were targeted to be taken away from Ambode’s residence for destruction so that evidence of alleged corruption that may come up against many leaders in the state would be destroyed. Fortunately, or unfortunately, Ambode had prior knowledge of the strange visit to his residence by the EFCC and put necessary structures in place for resistance.

Members of Epe community – both old and young, men and women – were waiting, lawyers were waiting, selected journalists were waiting, and that was how the EFCC plot was foiled,” our source declared.
It was noted that in furtherance of the vigilance and preparedness of the former Lagos governor to fight back that his team of lawyers issued a statement in Lagos on Tuesday after the EFCC episode.

In the statement captioned: “The attempt of the EFCC officials led by Rotimi Oyedepo, Esq to incriminate the EX Governor, Mr. Akinwunmi Ambode, with foreign currency; resisted by young lawyers in Epe”, the team of lawyers which comprise of Fatai A. Adebanjo, Esq., Busari M. Olanrewaju, Esq. and Samson K. Okuneye, Esq. narrated that in early hours of Tuesday, they were duly briefed that some EFCC officers invaded the apartment of Ambode with the intention to search the premises.

The lawyers on arrival at the residence held consultations with the EFCC officials to inquire and confirm if they had search warrant for the operation.
The lawyers said they objected when the EFCC officials attempted to prevent them from entering the house with them, insisting on only the EFCC officials going into the house for the search operations.
“Before they entered, we searched all the officials of the EFCC who intended to go in to effect the search.

“There was a blue bag which they were holding with them, we requested to see the content of the bag before they could take it in. They got angry and said we cannot see the content. Having said that, we strongly resisted them to take it in since they can’t allow us to see it, which they later agreed. We later got to know that the bag contained foreign currency which they brought to plant in the house of the Ex-Governor to incriminate him,” the lawyers declared in the statement they jointly signed.

The lawyers further said: “All documents, including the State Executive Exco Meetings Vol 1 – 16 in the personal study of the ex-Governor and His Luggage room which they intended to take along with them for further investigation was resisted by us as we told them that failure to take records of all the documents from A-Z, they cannot go out with anything and they agreed with us.”
The lawyers maintained: “Flowing from the aforesaid, they searched the nooks and crannies of the Ex Governor’s house and they couldn’t find any incriminating documents or materials. We authoritatively assert that, they did find anything in the house and they didn’t leave the house with anything.

“We followed them as they entered from one place to the other, when our presence was intimidating them, they said we should sit down while they will do the search. We resisted that we must follow them to observe every of their activities in the premises.”

Our source added that the episode of Tuesday brought the attack against the former governor to a stalemate, noting that all parties now have access to power at the national level; and that the governor is now ready to fight in the open.

Our source stated that the former governor has purportedly threatened to leak documents on expenditures, contracts, official and unofficial or ‘royalty’ payments to former governors and others in Lagos State if he is pushed to the wall.

Let Senate Introduce Bill against Corruption and Looting

According to Oxfam dictionary define hate speech as abusive or threatening speech or writing that expresses prejudice against a particular group, especially on the basis of race, religion, or sexual orientation.

Nigerians may recall that the bill which was hitherto abandoned under pressure last year imposes death penalty on “any person found guilty of any form of hate speech that results in the death of another person. The upper legislative chambers drop the move last year due to massive outcry from Nigerians. However, on Tuesday came the reintroduction tagged “National Commission For the Prohibition of Hate Speeches”, sponsored by the Deputy Chief Whip of the Senate, Abdullahi Aliyu Sabi (APC, Niger State).

The bill stipulates: “Any person who commits an offence under this section shall be liable to life imprisonment and where the act causes any loss of life, the person shall be punished with death by hanging. On offences like harassment on the basis of ethnicity, racial contempt, the bill proposes not less than five-year jail term or a fine of not less than N10 million or both.

“A person who uses, publishes, presents, produces, plays, provides, distributes and /or directs the performance of, any material, written and/or visual which is threatening, abusive or insulting or involves the use of threatening, abusive or insulting words or behaviour commits an offence if such a person intends thereby to stir up ethnic hatred, or having regard to all the circumstances, ethnic hatred is likely to be stirred up against any person or person from such an ethnic group in Nigeria.

But one thing Deputy Chief Whip of the Senate forgotten in preferring the bill is under section 39 of the 1999 Constitution which guarantees freedom of expression become, not just treasonable felony (life imprisonment) but treason itself that is punishable with death?

“Article 19 of the Universal Declaration of Human Rights guarantees freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers. Nigeria is a signatory to this international instrument.”Accordingly, Article 9 of the African Charter on Human and Peoples Rights, also domesticated in Nigeria, reinforces this inalienable freedom that the NASS is attempting to disrobe and destroy. The bill is an ill-intentioned, ill-conceived, ill-digested and dictatorial and absolutist piece of nonsensical legislation waiting to consume all of us. What made me laugh part of the bill which prescribes death by hanging but forgotten already the nation’s constitution deal with this issue law of libel and defamation was enough to handle hate speeches.

Senate introduction of a bill seeking to establish a Federal Government agency to check hate speech in the country shows how they are always prepared to waste public funds at the slightest opportunity, there is enough agencies and laws in Nigeria to take care of hate speech. Our problem is not the availability of laws or agencies but the implementation and enforcement of the laws by the existing agencies.

For whatever it is worth, the Senate had better know that the Nigerian constitution has a binding force on them and that any law they pass that is inconsistent with the provisions of the Nigerian constitution that guarantees freedom of speech and expression will be null and void to the extent of that inconsistency. What Nigerians wanted is to see one a bill tagged “National Commission for the Prohibition of Corruption and Looting. The bill to stipulate: “Any public officials who commit an offence of corruption or looting public funds under this section shall be liable of public execution or death by hanging publicly. In other part of the bill need for special court to be create so that it will handling all corruption cases apart from our conventional courts while Judiciary, police and DSS needs to be strengthened in line with bill.

This is bill Nigerians expects to see we want to see our lawmakers to be tougher on corruption and insecurity, on secretive employments, poor health facilities etc which may require that you isolate this debilitating scourge from politics. Believe me, what you do from now on as lawmakers will determine whether this nation will be strong enough to deal with challenges of the future, or it will go under because its cumulative problems have been left unattended by our leaders and lawmakers.

Am sure this bill will deal with secretive recruitment: secret after secret in every government employment drive such as NNPC, CBN, NCC, SEC to mention a few, where recruitment was conducted secretly and only the children of well-to-do Nigerians were given offers without due process being followed while sons and daughters of poor ones that spent several hours in the polling stations remain jobless. Nigerians witnessed many cases of corruption committed by government officials that divert public funds to personal use.

Straight from Nigerians heart, are not induced with the way the past and present administration conducting war on corruption because the brawl is not moving fast enough. Notwithstanding the high-profile corrupt Nigerians pending at various courts there have been no convictions of the alleged looters. Even the high profile corruption cases like Defencegate or Dasukigate. Another demoralizing scandal that rocked the nation was $43 million NIA safekeeping money. There was also the Grass cutting scandal where the issue of most expensive grass cutting and diversion of several trucks of food for IDPs in the ravaged North-East and awarded contracts running several hundred million of naira to suspected companies linked to one former government official corruptly benefited from contracts.

If our lawmakers consider the need for upcoming National Commission for the Prohibition of Corruption and Looting Bill we want it to be table before the house as a bill for urgent important matters. Nigerians will be happy with you distinguished senators. I am sure Nigerians will be delight with senate on this part and bill to be read soon in the shallow chamber and forward it to President Muhammadu Buhari. PMB will gladly assent the bill into law because it will be in line with administration derived war on corruption.

Okowa tells Asaba/Ilah/Uromi road users to avoid the road for now …Urged Fed Govt on total rehabilitation

…Udu bridge is okay for use

The Delta State Commissioner for Works, Mr James Augoye, yesterday announced the partial closure of the Asaba/Ilah/Uromi federal road, following the collapse of a three cell culvert due to the velocity of water.

Augoye who made this known while chatting with newsmen in Asaba, said: “It is no longer advisable for motorists to continue using the road. The section eaten by water is as deep as one meter.

“We have informed the Federal Government about the development. But in the interim, we have contacted our contractors to fill the sections washed off by water. They will fill the eroded embarkment with laterite.

“We have also decided to close the lane that has failed, and there are diversions for motorists. We have informed officials of Delta State Transport Management Agency, DESTMA and Federal Road Safety Corps, FRSC to be on ground to ensure non-usage of the closed section.”

Speaking further, he assured motorists plying Enerhen road in Warri area of the state that the Udu bridge is safe for use, adding that the concrete bridge built in 1970 by Dumex Construction Company did not fail. Insisting that the bridge is very healthy for motorists, Augoye said when the disturbing report about the purported failure of the bridge got to his office, a team of engineers were dispatched to carry out integrity test.

According to him, “from the investigation, there is nothing wrong with the bridge”, saying that “the bridge is safe, the only problem is the hand rail which runs through the entire bridge. The rails will be vibrating when driving through. A section of it fell off which is resulting in the vibration because part of it is suspended for now.

“Once we are done with the replacement, the vibration will stop. We are going to do a comprehensive rehabilitation of the rails to make it modern”.

The State Commissioner who was flanked by the Commissioner for Information, Mr Charles Aniagwu, called on the Federal Government to urgently undertake a comprehensive rehabilitation of the Benin/Sapele/Warri highway.

Augoye said the palliative measures the state government was putting in place to make the road motorable is being overwhelmed by rate of failure of different sections of the road.

Ojougboh replies Senator Manager over NDDC 300 Phatom Contracts *says matter forwarded to Anti-corruption Agencies

Following a report credited to the Senator James Manager challenging Dr. Cairo Ojougboh, Ag. Executive Director (Projects), of NDDC to name the Senator who allegedly have 300 NDDC jobs, Dr. Cairo Ojougboh yesterday replied Senator James Manager saying that the Commission has already forwarded the issue to the anti-corruption agencies, saying that the particular senator would soon be known.

It would be recalled that Dr. Ojougboh, Ag. EDP of the NDDC Interim Committee, had dropped a bombshell, when he alleged during a press conference on November 4, that a Senator, who is also a member of the Senate Committee on NDDC had 300 jobs for which payment had already been made without any sign that such jobs ever existed.

However, not satisfied with the statement, Senator James Manager Representing Delta South in an online report credited to him challenged Dr. Cairo Ojougboh to name the Senator to have allegedly own over 300 Jobs in NDDC.

Manager had in his statement said; “I am currently out of the country on an official trip. I have been inundated with several communications about what Hon. Dr.Cairo Ojougboh said about NDDC and a Delta Senator on award of contracts. I

“I have always known Dr Cairo to be a bold, fearless, courageous and tall man. On this matter he appears to be a disastrous disappointment on his failure to name the particular Senator from Delta that is involved. Instead his outburst has given job to pull him down heavy weight politicians and their ever ready hangouts to make stupendous insinuations and innuendos.”

But in a swift reaction, the Executive Director of Projects NDDC, Dr. Cairo Ojougboh replied Senator James Manager, saying the particular senator would soon be invited by the anti-corruption agencies for questioning.

Ojougbo in a statement made available to journalists said; “The Commission has forwarded the matter to the anti corruption agencies and the particular Senator will soon be invited and the public will know the person soon”.

He noted that the Interim Managment Committe (IMC) will continue to carry out inspections and verification of abandoned and ongoing NDDC projects in the region and also ensure an enabling environment for the forensic audit to take place.
